Sectoral Rules Biosafety in the development of activities with living modified organisms agricultural or forestry use and / or their products

SUPREME DECREE N º 003-2011-AG

THE PRESIDENT OF THE REPUBLIC


WHEREAS:


That, by Law N º 27104 - Law on Prevention of Risks from the Use of Biotechnology, regulates the safety of biotechnology in accordance with the Constitution and the Convention on Biological Diversity, approved by Legislative Resolution No. 26181;


That, under Rule 6 of the said Act, approved by Supreme Decree N º 108-2002-PCM, the sectoral bodies Agriculture Sector, responsible for security and management of biotechnology, is the Institute National Agricultural Innovation - INIA;


That paragraph b) of Article 7 of Regulation bounded, states that is a function of sectoral bodies to develop the Internal Sector on the mechanisms and procedures for decision-making and institutional strengthening;


That the Third Supplementary Provision Final Legislative Decree No. 1060, which regulates the National System Agricultural Innovation, gives the National Institute for Agricultural Innovation - INIA, sanctioning authority in the area of \u200b\u200bjurisdiction so that it can apply the administrative penalties of fines, denial, suspension or cancellation of registration, permits, licenses or permits, seizure, destruction or disposal of products infringed and closure of facilities or establishments;


That the sectoral bodies of the Agriculture Sector in the exercise of its functions, has developed the Rules Manager for the development of activities with living modified organisms agricultural or forestry and / or products, so that these activities take place without affecting human health and biodiversity;


In exercise of the power conferred by paragraph 8) of Article 118 of the Constitution of Peru and in accordance with the Law No. 29158 and Legislative Decree No. 997;


DECREES:


Article 1 .- Approval

To approve the Internal Security Sector of Biotechnology in the development of activities with living modified organisms agricultural or forestry and / or their derivatives, consisting of eight (8) degrees, seventy-two (72) articles, four (04) Supplementary Provisions final two (02) Additional transitional provisions and two (02) attachments.


Article 2 .- Publication and the effect

hereof be published in the official gazette El Peruano and the Regulations approved by the Peruvian Government Portal (www.peru.gob.pe), on the website of the Ministry Agriculture (www.minag.gob.pe) and the portal of the National Institute for Agrarian Innovation (www.inia.gob.pe).


The validity of that regulation will be from the day following the publication hereof.


Article 3 .- Endorsement

This Supreme Decree shall be countersigned by the Minister of Agriculture.
